Café Inn Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Café Inn app, website, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. Eligibility

You may use the Service only if:

• you can form a binding contract;
• you are at least 13 years old, or older where local law requires;
• you are not prohibited from using the Service under applicable law;
• you provide accurate information and keep your account secure.

If you purchase a subscription, you represent that you are authorized to use the payment method linked to your app store account and satisfy any age requirements for paid transactions.

2. The Service

Café Inn is a coffee logging and social discovery service that may include personal tracking, public posting, photos, ratings, reactions, leaderboards, recaps, statistics, notifications, paid features, sharing tools, and related functionality.

We may add, remove, suspend, or modify features at any time. Some future features may be subject to additional guidelines, disclosures, or supplemental terms.

3. Your Account

You are responsible for:

• maintaining the security of your account and connected sign-in methods;
• all activity that occurs under your account;
• ensuring that profile and content information you provide is accurate and lawful.

You may not impersonate another person, misrepresent your affiliation, or claim a username in a way that violates another party's rights.

4. Your Content

You retain ownership of the content you create or upload, including profile information, photos, coffee entries, notes, ratings, and reactions ("User Content").

By submitting User Content to the Service, you grant Café Inn a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, format, publish, display, distribute, and otherwise use that User Content as necessary to operate, provide, improve, secure, and promote the Service. This includes making public content visible to other users, generating recaps and rankings, moderating content, and using technical transformations needed to display content across devices and formats.

This license ends within a commercially reasonable time after your User Content is deleted from the Service, except to the extent the content:

• has been shared with others;
• has been retained in backups, logs, or archival systems;
• must be kept for legal, security, or enforcement reasons.

You represent that:

• you own or control the rights to your User Content;
• your User Content does not violate law, privacy rights, publicity rights, or intellectual property rights;
• you have permission to upload any photo, review, location, or other information you submit.

5. Public Content and Community Features

The Service includes community features. If you post public content, it may be visible to other users and may be copied, reshared, discussed, or referenced by them inside or outside the Service.

You understand that:

• profile information and public entries may appear in feeds, rankings, notifications, discovery surfaces, and promotional placements related to the Service;
• ratings, reactions, and leaderboard placement may be associated with your account;
• deleting content may not remove copies already viewed, cached, or shared by others.

6. Acceptable Use

You may not use the Service to:

• break the law or encourage unlawful conduct;
• harass, threaten, defame, stalk, exploit, or harm others;
• upload content that is fraudulent, infringing, deceptive, obscene, hateful, or otherwise objectionable;
• post someone else's personal data or precise private location without permission;
• manipulate ratings, reactions, rankings, referrals, subscriptions, or analytics;
• scrape, crawl, reverse engineer, interfere with, or disrupt the Service;
• bypass access controls, security measures, or usage limits;
• distribute malware, spam, or unauthorized advertising;
• use the Service in a way that could damage Café Inn, other users, or third parties.

7. Moderation and Enforcement

We may review, remove, restrict, or refuse content or accounts that we believe violate these Terms, applicable law, platform rules, or the safety and integrity of the Service.

We may suspend or terminate access without prior notice where reasonably necessary to investigate abuse, fraud, security issues, legal claims, or repeated violations.

8. Paid Features and Subscriptions

Certain features may require a paid subscription or purchase.

If you subscribe through an app store:

• billing, renewals, cancellations, refunds, and payment processing are handled by the relevant app store or payment platform;
• subscriptions may renew automatically unless cancelled before the renewal date;
• pricing and availability may change;
• your access to paid features may end if your subscription lapses or is revoked.

Free trials, introductory offers, and promotional pricing may be subject to additional conditions.

9. Third-Party Services

The Service may integrate with or rely on third-party services, including sign-in providers, app stores, subscription processors, analytics tools, crash-reporting tools, map providers, messaging services, sharing tools, and support channels.

We are not responsible for third-party services, content, or policies. Your use of third-party services is governed by their own terms.

10. Intellectual Property

The Service, including its software, branding, design, text, graphics, logos, and other non-user content, is owned by Café Inn or its licensors and is protected by intellectual property laws.

Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, license, or create derivative works from the Service.

11. Privacy

Your use of the Service is also governed by the Café Inn Privacy Policy.

12. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Café Inn disclaims warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

We do not guarantee that:

• the Service will always be secure, available, or error-free;
• content posted by users is accurate, complete, or reliable;
• rankings, ratings, statistics, or analytics are free from delay, error, or manipulation.

Content on the Service is for informational and community purposes only and is not professional, medical, nutritional, financial, or legal advice.

13. Limitation of Liability

To the maximum extent permitted by law, Café Inn and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, goodwill, data, or business opportunities arising out of or related to the Service or these Terms.

To the maximum extent permitted by law, Café Inn's total liability for any claim relating to the Service will not exceed the greater of:

• the amount you paid to Café Inn for the Service in the 12 months before the claim arose; or
• USD $100.

Some jurisdictions do not allow certain liability limitations, so some of the above may not apply to you.

14. Indemnity

To the extent permitted by law, you will indemnify and hold harmless Café Inn and its affiliates, officers, employees, contractors, licensors, and service providers from claims, liabilities, damages, losses, and expenses arising from:

• your User Content;
• your misuse of the Service;
• your violation of these Terms or applicable law;
• your infringement of another person's rights.

15. Termination

You may stop using the Service at any time.

We may suspend or terminate your account or access if:

• you violate these Terms;
• we are required to do so by law;
• your use creates risk or potential legal exposure for Café Inn or others;
• the Service, or part of it, is discontinued.

Sections that by their nature should survive termination will survive, including provisions on licenses, intellectual property, disclaimers, liability, indemnity, dispute-related provisions, and enforcement.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms, update the effective date above, and provide additional notice where required.

Your continued use of the Service after the updated Terms take effect means you accept the updated Terms.
